Texas Pete Richmond Raceway Sweepstakes (the “Sweepstakes”)
Official Rules (“Official Rules” or “Rules”)
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED FOR THE SWEEPSTAKES. THIS SWEEPSTAKES IS GOVERNED EXCLUSIVELY BY THE LAWS OF THE UNITED STATES AND IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO MEET THE ELIGIBILITY REQUIREMENTS SET FORTH HEREIN. VOID WHERE PROHIBITED BY LAW. BY ENTERING THE SWEEPSTAKES, EACH ENTRANT AGREES TO THESE OFFICIAL RULES. YOU MUST FOLLOW THE DIRECTIONS PROVIDED IN THESE OFFICIAL RULES IN ORDER TO PARTICIPATE IN, AND RECEIVE A PRIZE IN CONNECTION WITH, THE SWEEPSTAKES.
Sponsor: T.W. Garner Food Company, 1614 W. Fourth Street, Winston-Salem, NC 27101 (“Sponsor”).
Administrator: Brandmovers, Inc., 1519 Carroll Drive, Atlanta, GA 30318 (“Administrator”).
- Eligibility. The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia who are 18 years or older or the age of majority in their state of residence (which is nineteen (19) in Alabama and Nebraska, twenty-one (21) in Mississippi, and eighteen (18) in all other states) as of the date of entry (the “Entrant”). Void outside of the 50 United States, the District of Columbia, and where prohibited, taxed, or restricted by law. Officers, directors, managers, and employees of Sponsor or any of its affiliates, subsidiaries, advertising agencies, or any other company or individual involved with the design, production, execution, or distribution of the Sweepstakes, including Administrator (collectively, the “Sweepstakes Entities”), and the immediate family members (spouse, parents, parents-in-law, step-parents, siblings, siblings-in-law, and step- siblings, and children and step-children) and household members (whether or not they are related) of each such individual are not eligible to enter or win. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. The Sweepstakes may only be entered in or from the fifty (50) United States or the District of Columbia, and entries originating from any other jurisdiction are not eligible for entry.
- Sweepstakes Period. The Sweepstakes begins at 12:00:00 AM Eastern Daylight Time (“EDT”) on June 8, 2026, and ends at 11:59:59 PM EDT on July 31, 2026 (the “Sweepstakes Period”). Sponsor is the official timekeeper for this Sweepstakes.
- How To Enter. There are two (2) ways to enter the Sweepstakes during the Sweepstakes Period: (1)
look for the Sweepstakes QR code at participating Kroger-Mid-Atlantic locations and scan the QR
code using your smart phone, which will take you to the Sweepstakes landing page, where you can
complete and submit the entry form to receive one (1) entry into the Sweepstakes, or (2) visit the
Sweepstakes landing page directly at www.texaspeterichmondraceexperience.com (the “Website”)
and complete and submit the entry form to receive one (1) entry into the Sweepstakes. Limit one (1)
entry per person during the entire Sweepstakes Period. All entries must be submitted by 11:59:59
PM EDT on July 31, 2026, to be eligible for entry into the Sweepstakes random drawing.
Entries submitted by anyone other than the Entrant are void. In the event of a dispute regarding the identity of the Entrant, the authorized account holder of said email account at the time of entry will be considered the Entrant. “Authorized account holder” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted email address.
Neither Sponsor nor any Sweepstakes Entity is responsible for any entry that is lost, late, incomplete, invalid, or unintelligible, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, destruction or failures, faulty transmissions or other telecommunications malfunctions, human error, entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, faulty transmissions, technical malfunctions, or otherwise. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor or any Sweepstakes Entity.
Any attempt to enter the Sweepstakes by using multiple/different identities, or any other methods may disqualify that individual from winning any prize, at the sole discretion of Sponsor. Use of any automated system to participate in the Sweepstakes is prohibited and may result in disqualification, in Sponsor’s sole discretion. - Random Drawing; Winner Notifications; Claiming a Prize.
One (1) Grand Prize and ten (10) First
Prize winners will be randomly selected by Administrator from all eligible entries received during the
Sweepstakes Period on or about August 3, 2026 (each, a “Potential Prize Winner”). Odds of winning
depend on the number of eligible Entries received during the Sweepstakes Period. By entering the
Sweepstakes, Entrants fully and unconditionally agree to be bound by these Official Rules and the
decisions of Sponsor and the Sweepstakes Entities, which will be final and binding in all matters
relating to the Sweepstakes.
Potential Winner Notifications. Each Potential Winner will be contacted by Sponsor or Administrator via email, sent to the email address as provided by each Potential Winner on his or her entry form (each, a “Winner Notification”). The Winner Notification message will be sent on or about the day the Potential Winner is selected. Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of the Potential Winners is final and binding in all matters related to the Sweepstakes. The Potential Winners must respond to the Winner Notification message to verify their complete mailing address within forty-eight (48) hours of Administrator or Sponsor sending the Winner Notification. Failure to respond to the Winner Notification and verify and/or provide a complete mailing address within the 48-hour deadline for any reason may result in disqualification of a Potential Winner, and an alternate Potential Winner may be selected, time permitting, in Sponsor’s sole discretion. Sponsor may select up to three (3) alternate Potential Winners per available Prize (as defined below). In the event Sponsor is unable to award a Prize after attempting to award a Prize to the original Potential Winner and up to three (3) alternates, that Prize will not be awarded. Neither Sponsor nor Administrator are responsible for Winner Notifications or responses that go into spam or junk folders, are unanswered within 48 hours, are undeliverable, or for any technical glitches or other issues interfering with the Winner Notification process.
Claiming a First Prize. Upon Administrator or Sponsor’s receipt of potential first prize winner’s (“Potential First Prize Winner”) email response to the Winner Notification message by the 48-hour deadline, including verification of Potential First Prize Winner’s complete mailing address, Sponsor will mail out the First Prize to the Potential First Prize Winner. Allow 6 to 8 weeks fo r the mailing of any First Prize. Neither Sponsor nor any other Sweepstakes Entities are responsible for lost, late, delayed, stolen, damaged, returned or mutilated mailing of any First Prize. In the event that a prize is returned, the address is insufficient or incomplete, or is undeliverable for any reason, the winner will be disqualified and an alternate winner may be selected from the remaining eligible entries, in the discretion of Sponsor, as set forth herein.
Claiming the Grand Prize: In order to receive the Grand Prize, upon Administrator or Sponsor’s receipt of the potential grand prize winner’s (“Potential Grand Prize Winner”) response to the Winner Notification message by the 48-hour deadline, Administrator or Sponsor will then email the Potential Grand Prize Winner an Affidavit of Eligibility, Liability & Publicity Release (where legal), along with a W-9 tax form (where applicable) (collectively, the “Paperwork”) that the Potential Grand Prize winner is required to complete, sign and submit to Administrator as instructed within two (2) business days of Administrator emailing the Paperwork to the Potential Grand Prize Winner. In the event the Potential Grand Prize Winner fails to return the signed and completed Paperwork as instructed within the two (2) day timeframe or is otherwise found to be ineligible to receive the Grand Prize, the Potential Grand Prize Winner forfeits his or her right to the Grand Prize, and an alternate Potential Grand Prize Winner may be selected in Sponsor’s sole discretion as set forth above, time permitting. Neither Sponsor nor any Sweepstakes Entity is responsible for emails that are not checked or delivered or that go into a spam or junk folder, or for lost, late, delayed, misdirected, or returned emails or any technical glitch associated with the emailing the notification, verification or Paperwork. Upon receipt of the signed and completed Paperwork, provided that the Potential Grand Prize Winner is not found to be ineligible for the Grand Prize, Sponsor will mail and/or email the Grand Prize to the Potential Grand Prize Winner, at which time the Potential Grand Prize Winner will be considered the grand prize winner (the “Grand Prize Winner”). In the event that a prize is returned, the address is insufficient or incomplete, or the prize is undeliverable for any reason, the Grand Prize Winner will be disqualified and an alternate winner may be selected from the remaining eligible entries, in the discretion of Sponsor, as set forth herein. - Prizes and Approximate Retail Values (“ARVs”). There will be One (1) Grand Prize, consisting
of a NASCAR Cook Out 400 Cup Series Experience on August 15, 2026, in Richmond, VA (the
“Race”) for the Grand Prize Winner and one (1) guest. The Race experience includes: two (2)
Grandstand Tickets for the Race for the Grand Prize Winner and one (1) guest; two (2) GAP Passes
for the Grand Prize Winner and one (1) guest; two (2) drivers’ meeting wristbands for the Grand Prize
Winner and one (1) guest; one (1) parking pass for the Race day; one (1) Richmond Raceway hat;
one (1) Richmond Raceway shirt; one (1) Texas Pete Racing hat; and one (1) Texas Pete Racing
shirt. ARV: $2,050.00. TRANSPORTATION AND LODGING ARE NOT INCLUDED AS PART OF
THE GRAND PRIZE WHICH IS THE SOLE RESPONSIBILITY OF THE GRAND PRIZE WINNER
AND HIS OR HER GUEST. The guest of the Grand Prize Winner must be at least 18 years of age or
older. Tickets are subject to the terms, conditions and restrictions printed on or accompanying the
tickets. Seat locations are at Sponsor’s sole discretion. The Grand Prize Winner is solely
responsible for any costs incurred to enjoy the Grand Prize that are not specifically included in the
Grand Prize description of these Official Rules.
There will be Ten (10) First Prizes of a Richmond Raceway prize pack, each consisting of: one (1) Richmond Raceway hat; one (1) Richmond Raceway shirt; one (1) Richmond Raceway diecast miniature car; one (1) Richmond Raceway sticker; one (1) Sponsor-specified Texas Pete product; one (1) Texas Pete hat; one (1) Texas Pete bandana; two (2) Texas Pete koozies; and one (1) Texas Pete hand towel. ARV: $145.00 each.
The total ARV of all Prizes is $3,500.00. Prizes are subject to availability, are non-transferable, non-negotiable, and not substitutable by the winner. Sponsor reserves the right to substitute a Prize, or component thereof, for one of equal or greater value for any reason at its sole discretion. All local, state and federal taxes (including, without limitation, state and federal income taxes) and the reporting consequences thereof, are the sole responsibility of the winner. Sponsor will submit a 1099 to proper taxing authorities in connection with the Grand Prize.
No compensation will be provided for any prizes that are not able to be awarded to a prize winner. - Entry Conditions and Release. By entering, each Entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor and the Sweepstakes Entities, which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless Sponsor and the Sweepstakes Entities from and against any and all claims, expenses, and liability, including but not limited to claims relating to negligence, damages of any kind to persons and property, invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury, in each case arising out of or relating to an entry, participation in the Sweepstakes, or acceptance or use or misuse of any Prize; and (c) indemnify, defend and hold harmless Sponsor and the Sweepstakes Entities from and against any and all claims, expenses, and liabilities (including, without limitation, reasonable attorneys’ fees) arising out of or relating to an Entrant’s participation in the Sweepstakes and/or an Entrant’s acceptance, use or misuse of a Prize.
- General Conditions. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, for any reason whatsoever, including, without limitation, fire, flood, hurricane, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction or if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible, where such drawing does not compromise the odds) select the Winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each Entrant’s sole and exclusive remedy under such circumstances. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages (including attorneys’ fees) from any such person to the fullest extent permitted by law. Only the type and quantity of prizes described in these Official Rules will be awarded. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of these provisions.
- Limitations of Liability. Neither Sponsor nor the Sweepstakes Entities are responsible for: (1) any incorrect or inaccurate information, whether caused by an Entrant, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an Entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, such Entrant’s sole remedy is a replacement entry in the Sweepstakes, provided that if it is not possible to award another entry due to discontinuance of the Sweepstakes, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Each Entrant further agrees and acknowledges that Sponsor reserves the right to forfeit or award any unclaimed or leftover Prize at its sole discretion.
- Privacy. Information provided for this Sweepstakes is subject to Sponsor’s privacy policy at https://garnerfoods.com/privacy-policy/. f you are selected as a Winner, your information will also be included in a publicly available winner’s list. By entering this Sweepstakes, each Entrant agrees that Sponsor and/or Administrator have the right to contact the Entrant via the email account provided by the Entrant on the entry form to administer and/or fulfill this Sweepstakes.
- Disputes/Governing Law. By participating in the Sweepstakes, each Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the State and Federal courts located in Forsyth County, North Carolina; (b) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT ATTORNEYS’ FEES; AND (c) UNDER NO CIRCUMSTANCES WILL AN ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND EACH ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM INDIRECT, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT- OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of an Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of North Carolina without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina. Each Entrant hereby irrevocably consents to the personal jurisdiction of said courts and waives any claim of forum non conveniens or lack of personal jurisdiction that they may have. If any provision of these Official Rules is declared invalid or unenforceable, such provision will be deemed modified to the extent necessary and possible to render it valid and enforceable. In any event, the unenforceability or invalidity of any provision will not affect any other provision of these Official Rules, and these Official Rules will continue in full force and effect, and be construed and enforced, as if such provision had not been included, or had been modified as described above, as the case may be.
- Publicity. Except where prohibited by law, each winner grants (and agrees to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use his/her/their name, hometown and state, and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without compensation.
